Abstract
Critical Information Infrastructure (CII) has now become an indispensable part of national security in the light of dependence of governments, banks, communication networks, energy sectors, transport, health care facilities, and other vital sectors on digital infrastructure. Interference or breach of such infrastructure is not limited to cybercrime but may threaten economic stability, public safety, governance and resilience of the nation. In India, protection of CII includes legal and technical measures as provided by the Information Technology Act, 2000, Information Technology Rules, cybersecurity directions, institutional arrangement for critical information infrastructure protection and cyber incident response mechanism. However, advancements in cyber-attack techniques, ransomware, supply chain interference, insider threat, and attacks on interconnected systems have presented new challenges that cannot be tackled merely using criminal laws. The present paper analyses the Indian cybersecurity regime with the focus on the protection of CII and national security. The research discusses the legal and institutional framework that regulates the process of identifying, protecting, monitoring, and responding to critical infrastructure. In addition, the paper analyses the problems related to institutional coordination data, privacy, accountability, and cooperation between the public sector and private enterprises. In general, it is necessary to mention that successful protection of CII depends on the implementation of comprehensive legal framework with support of institutions, information exchange, resilience, and accountability.References
